What is the UAE midday break rule in 2026?

From 15 June to 15 September 2026 — the 22th year of the MoHRE heat-stress policy — no one may work under direct sun or in open-air places between 12:30 and 15:00, every day including weekends and Eid. The fine is AED 5,000 per worker, up to AED 50,000. The break is paid rest: a 07:00–17:00 crew of 20 loses 50 paid labour-hours a day and about 4,000 over the 93-day season on a six-day week. Starting at 04:30 and finishing at 14:30 keeps the same 7.5 worked hours with no ban overlap and no overtime; the Labour Law still requires a rest break once a work block passes 5 hours, and hours before 04:00 attract the night premium.

Employer duties during the ban: shaded rest area, industrial cooling, water and electrolyte drinks, first-aid kit and trained first-aider, daily schedule posted in workers' languages. Exemptions need a permit and apply to technically continuous work (concrete pours, asphalt, utility emergencies, traffic-management works).

Midday Break — FAQ

From 15 June to 15 September 2026 work under direct sunlight or in open-air places is prohibited between 12:30 and 15:00 every day, including Saturdays, Sundays, public holidays and Eid. This is the 22th year of the Ministry of Human Resources and Emiratisation (MoHRE) policy. Employers must provide shaded rest areas, cooling, water and hydrating food, first aid on site, and post the daily schedule in a language workers understand.
Anyone working in open air or under direct sun: construction, road works, landscaping, cleaning, delivery riders, loaders and porters, surveyors, and drivers while they are outside the vehicle loading, unloading or doing roadside work. Driving an air-conditioned cab is not banned, but the stop at the customer usually is. Exempt: work that must run continuously for technical reasons (concrete pours, cutting off traffic, emergency repairs to utilities) with a permit and extra heat-stress controls.
AED 5,000 per worker found working during the ban, up to AED 50,000 for multiple workers or repeat violations, plus possible suspension of the establishment's file. MoHRE inspectors visit sites unannounced and the public can report violations via the MoHRE app or 600 590000. Inspections typically run into the tens of thousands per season.
Federal Decree-Law No. 33 of 2021 caps normal hours at 8 a day and 48 a week, with at most 2 hours of overtime a day at +25% (+50% between 22:00 and 04:00), and a rest break once 5 consecutive hours are worked. The midday break is paid rest, not unpaid time — so a 07:00–17:00 roster pays ten hours for 7.5 worked. Starting earlier keeps hours without overtime, up to the 04:00 night boundary.
Attendance and vehicle data prove compliance and catch breaches before an inspector does: an alert when a vehicle is unloading at a site or a rider is moving between 12:30 and 15:00, geofence reports showing which crews were at which site during the ban, and heat-stress rest logged as an attendance state.
